PROTECTION OF PERSONAL DATA AND INFORMATION SECURITY
REGULATORY FRAMEWORK
The Altea City Council is governed in matters of personal data protection and information security primarily by the following regulatory frameworks:

  • Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, concerning the protection of individuals with regard to the processing of their personal data and the free movement of such data (hereinafter GDPR).
  • Organic Law 3/2018 of December 5, on Protection of Personal Data and guarantee of digital rights (hereinafter LOPDGDD).
  • Royal Decree 3/2010 of December 8. National Security Scheme (hereinafter ENS).
  • Royal Decree 951/2015, of October 23, amending Royal Decree 3/2010, of January 8, which regulates the National Security Scheme in the field of Electronic Administration.
  • Applicable regulatory developments, instructions, directives, standards, and guidelines on personal data protection and information security.

Based on the First Additional Provision of LOPDGDD -Security measures in the public sector- this City Council adopts the National Security Scheme as a reference regulatory framework for security measures applicable under LOPDGDD, in addition to its general applicability to City Council services and information, whether they process personal data or not.

Data Retention
Your data will be retained for the period established by the treatment, applicable legislation, and requirements for the retention of information by the Public Administration.

Legal Grounds / Applicable Legal Bases
The different municipal procedures and activities involve data processing based on various legal bases listed in the GDPR:

  • Consent of the interested party, when required.
  • Contractual relationship.
  • Vital interests of the data subject or other people.
  • Exercise of public powers conferred on the data controller and/or compliance with a legal obligation applicable to the data controller.
  • Development of municipal competencies granted by state and regional legislation governing local administration.

Recipients
Your data may be communicated to the competent public and/or private entities involved or necessary for the processing of procedures and/or management of municipal activities and in cases provided by law.

Rights
You may exercise your rights of access, rectification, erasure, objection, restriction of processing, portability, and (where applicable) withdrawal of consent given. Likewise, you may contact the Supervisory Authority to claim your rights.

To exercise these rights, you must submit a request to the Altea City Council, Register of Entry, José María Planelles Square, 1, 03590 Altea, indicating “Data Protection Officer”.

International Transfers
No international data transfers are made. In exceptional cases where necessary, the relevant authorization will be requested from the Supervisory Authority.
